In mid-October, new rules went into effect that will further protect the consumer from phone intrusions and pinch those sales outfits that work outside established ethical bounds.
The FCC last year amended the Telephone Consumer Protection Act of 1991 (TCPA) to address the relatively new issues of automated robocalls and calls to cell phones from auto dialers. The new rules went into effect Oct. 16.
Now telemarketers must obtain prior express written consent from the called party prior for autodialed or prerecorded telemarketing calls to wireless numbers and prerecorded calls to residential landlines. What’s more, there is no “grandfathering” of any consent that had been obtained under the FCC’s prior rules. The exclusion for an “established business relationship” has also been eliminated.
In order to place the automated calls, telemarketers must obtain new consent that is a “clear and conspicuous disclosure” that he/she will receive future calls that deliver autodialed and/or pre-recorded telemarketing messages on behalf of a specific advertiser. Limited exceptions apply to this requirement, such as calls/texts from the consumer’s cellular carrier, debt collectors, schools, informational notices and healthcare-related calls. Also, calls that are manually dialed and do not contain a pre-recorded message are exempt from the TCPA.
In short, telemarketing calls to wireless customers who have not provided their written permission are a no-no, and are in strict violation of the FCC rules.
